Personally, I'm withholding judgement on this guy either way until after the hearings. The Vanguard issue troubles me somewhat, but I believe the National Lawyers Association highly rates him.

The 'fact' of evolution is the common descent part. That all animals decend from previous animals. This is a fact that can only be invalidated by the existance of mystical forces.
A scientific fact is a item that is held to be true since to believe otherwise would be perverse. It is a scientific fact that the sun is not beginning to super nova. Since the light of the sun is about 11 minutes delayed it is possible that the sun has moved into such a state in the last 10 minutes, however to invalidate the conclusion that the sun is not in the process of novaing based on this 11 minute window is a perversion of logic.
An actual or simple fact is one that must be true. A dry plain cotton towel submerged into a 40 gallon tub of water for a few seconds and then withdrawn will be wet. F=MA is this type of fact. It is a simple fact since we have defined a concept of Force as the product of Mass and Acceleration. If a new item was added to the equation it was describe a different concept.
The foundation of evolution, common descent, is also a simple fact. The mechanism of evolution are the theories. How did organism evolve? Was Natural Selection the driving force or Random Drift? Was there a different method altogether? Much like dropping a pen and watching it fall is the fact of gravity the world arounds gives the same foundation for the fact of evolution.

Hmm I will clarify one point, the reason I siad F=MA is not a fact (despite it being Newtons second law) is it does not accout for relativistic speeds. At low velocities it is a close approximation of the actual Formula which does account for V and C.
Of courses noone during NEWTONS's time could measure things accurately at near light speed. So Newton was wrong, though he didn't Lie.
