Gart,
May I recommend as a place that gives a perhaps more fair accounting of it then Slate.
They do agree in the final post it was likley a drafting error, that caused it but reading it as it was written (a report that was co-authored by Ginsburg) she would seem to be endorsing it. Thus a person could very well belive thats what she was saying and not be lieing when they said that. IMHO if you say somethign you belive ot be true you may be mistaken, but you are not lieing.
Heres an example Newton stated that F=MA (his second law). That is incorrect as it fails to take into account the effect of current speed (only really relative at velocities approching the speed of light). In most cases this is a very clsoe approximation, but one should consider the relative speed as compared to the speed of light (it has been a long time and I forget the exact firmula) so if I am off on formula forgive me. I belive the sqrt(1/(C^2-V^2)) is the part he left out so he was wrong with his second law, but I would not say he lied.
